The Scriptoware Platform consists of a collection of software services developed and owned by SCRIPTOWARE INC, a registered entity based in Massachusetts, United States. The platform can be accessed through desktop or laptop browsers via the website at https://scriptoware.com and through mobile devices by using the iOS or Android application ("Application" or "App").

The Scriptoware Platform includes:

  • Cloud-Based Infrastructure:A scalable solution for storing and managing enterprise and healthcare data, which includes cloud PACS systems, vendor-neutral archives, and secure access that complies with data protection regulations (e.g., GDPR, HIPAA).
  • Scriptoware Node:A hardware/software unit installed at client locations to automate and secure the transfer of on-premise data (such as from PACS systems and modalities) to Scriptoware’s cloud.
  • Web Portal (Doctor Portal):A platform offering healthcare professionals access to clinical data and images through a DICOM viewer, with collaborative features such as case sharing, alerts, messaging, and video calls via Zoom.
  • Mobile App for Professionals:A mobile application that replicates the functionality of the Web Portal for healthcare professionals.
  • Patient Portal:A secure platform for patients to access their personal medical records and communicate with healthcare providers.

These Terms & Conditions govern all use and interaction with the Scriptoware Platform. The term “Site” refers to both the web interface and the mobile app, while “Scriptoware Platform” encompasses all services provided via the Site and App.

By accessing or using the Site, you confirm that you have read, understood, and agree to these Terms & Conditions. If you do not accept them, please stop using the Site.

Terminology

The following terms are defined as follows and apply throughout this agreement:

  • "User", "You", and "Your"refer to any individual accessing this Site.
  • "Scriptoware", "We", "Our" & "Us"refer to SCRIPTOWARE TECH PRIVATE LIMITED.
  • "Party" or "Parties"refers to both the User and Scriptoware collectively.

We reserve the right to modify these terms at any time. Users are encouraged to check this page regularly for updates. If you have any questions, please contact us using the email or address provided on the Site.

Subcontracting and Assignment

You are prohibited from:

  • Republishing any content from the Site.

Confidentiality Agreement

Information submitted to Scriptoware will be kept confidential, except as outlined in our Privacy Policy or when disclosure is required by law. By submitting data or content to the Site, you grant Scriptoware a non-exclusive, irrevocable right to use it unless otherwise restricted by applicable laws.

Limitation of Liability

To the fullest extent permitted by law, Scriptoware, its partners, employees, or service providers will not be liable for any direct or indirect damages, including but not limited to data loss, business interruptions, or technical issues resulting from the use of the Site. The Site and its services are provided “AS IS,” “WITH ALL FAULTS,” and “AS AVAILABLE.”

We do not guarantee:

  • Continuous availability of the Site or services.
  • The accuracy or completeness of data.
  • The qualifications or professional standing of healthcare providers using the platform.
  • Desired results from the usage of the Site.

We are not responsible for third-party content, advertisements, or links displayed on the Site.

User Accountability

Users are responsible for safeguarding their login credentials and any activities performed under their account.

By registering an account, you acknowledge and agree to abide by these Terms & Conditions.

Content Responsibility

You may only upload or post content if you possess the necessary rights. By submitting content, you grant Scriptoware an irrevocable license to use, display, and share it. This license remains in effect even if you stop using our services.

You agree to protect Scriptoware from any legal claims arising from the content you upload.

We are not responsible for user-generated content or content linked to third-party websites.

Embedded Frames (iFrames)

You are prohibited from using frames or tools to modify the visual presentation or branding of the Site without prior written approval.

Your Use of the Site

Please refrain from using the Site in any manner that violates these Terms, infringes on others' rights, is offensive, or interferes with the operation of the Site (including any technical controls we use to maintain these Terms).

If we, at our sole discretion, determine that your conduct is inappropriate, we reserve the right to delete your content, disable your account, block your access to the Site, and pursue any necessary legal actions. Accessing our Site does not grant you ownership of any intellectual property linked to the content available. You may not use materials from our Site unless you have received explicit permission from us or the content owner, or if you are otherwise permitted under the law.

By accessing the Site or sending messages through it, you are communicating with us electronically. You agree to receive electronic communications related to your use of the Site, which may be sent via email or other tools integrated into the Site. You agree that all terms, notifications, disclosures, and other communications provided electronically fulfill any legal obligation that requires written notice. Any message sent to your provided email address will be considered delivered. By submitting content, registering for an account, or sharing your contact details (email, postal address, or phone number), you consent to being contacted by us or our agents, in accordance with our Privacy Policy.

Doctor and Patient Subscriptions – Site Users

Scriptoware reserves the right to adjust pricing for doctor and patient subscriptions with a 30-day advance notice.

  • Individual Doctors – Free Accounts for Collaborating Doctors – 1GB StorageFree individual doctor accounts are available exclusively by invitation from an existing Scriptoware user. These accounts include 1GB of personal document storage and are specifically for doctors evaluating the Scriptoware Platform. For additional storage or extended access to the platform, please contact our sales team for a custom quote.
    Accounts for individual doctors that are active as of 10.12.2024 will remain active, but starting 09.01.2025, their storage will be capped at 1GB.
  • Potential Clients (clinics/hospitals/doctors) – Free trial of Scriptoware Starter for 14 days Scriptoware offers a free 14-day trial of its Starter subscription at https://www.scriptoware.com/pricing.The paid version of the Starter plan includes 500GB of storage and other benefits (see pricing page for details).
  • Patient AccountsPatient accounts are free of charge and offer 15 GB of storage. For additional space, please contact our sales department for a tailored pricing plan.

Your Account

Some features on the Site may require you to create an account and set a password. To register, you must be at least 16 years old and provide accurate personal information. Do not impersonate others when signing up. If any of your details change, update your account accordingly.

In certain cases, your account may be created by an administrator (such as a healthcare provider or employer). If you are assigned an account, additional terms may apply. Administrators may manage or disable your account independently.

Do not share your account credentials with others. Keep your password secure and avoid reusing it across other websites. If your account is compromised, notify us of your system administrator immediately.

Applicable Law and Jurisdiction

These Terms are governed by the laws of India. We will first attempt to resolve disputes amicably. Scriptoware is committed to resolving issues quickly and efficiently using all applicable legal means. If a resolution is not possible, the matter will be resolved by competent courts located in Ahmedabad, Gujarat.

Changes to the Site

We reserve the right to make changes to the Site at any time, with or without prior notice. This may involve adding or removing features or suspending specific functions altogether.
